The present personal data protection policy of Hotel Bourgogne & Montana is an appendix to the GTC ("General Terms and Conditions") and is therefore contractually binding. In the event of any contradiction between the GTC and the present policy, the GTC shall take precedence, which the user of our sites acknowledges and accepts.
This personal data protection policy reflects Hotel Bourgogne & Montana's desire to be completely transparent with site users about how it manages their personal data and incorporates the latest requirements arising from applicable legislation and regulations, and in particular the European Regulation on the Protection of Personal Data (RGPD).

The purpose of this Personal Data Protection Policy is to inform Users of the manner in which Hotel Bourgogne & Montana manages the personal data of users of its websites, whether or not they are customers (hereinafter "Users").

The only recipients of Users' personal data are :
- the relevant departments and employees of Hotel Bourgogne & Montana and the Biografy group (in particular: IT, sales/marketing, operations) bound by specific data protection obligations;
- companies assisting Hôtel Bourgogne & Montana in the operation and/or exploitation of the sites;
- Our hotels' subcontractors.
These structures only receive personal information that is strictly necessary for booking and calling back customers.
The processing of personal data by these structures is carried out in accordance with applicable legislation and regulations.
Article 5. What rights do Users have concerning the personal data collected?
The User has access to the rights detailed in Chapter III of the RGPD, including the following rights:
- Right of access to personal data collected on the Website
- Right to modify/rectify them,
- Right to erasure ("right to be forgotten"), unless there is a legal reason to keep it,
- Right to restrict processing, i.e. the right to ask us in certain cases to suspend the processing of personal data,
- Right to data portability, i.e. the right to request a copy of personal data in a common format (e.g. a .csv file),
- Right to object to the processing of personal data,
- Rights relating to individual decision-making and profiling, i.e. the right to ask us to be transparent about any profiling we carry out or any automated decisions,
All of these rights apply to data processing carried out via the Hôtel Bourgogne & Montana website and requesting personal information (registration forms, contact requests, reservation confirmations, etc.). Article 6. For how long are personal data collected?
Users' personal data is stored in accordance with applicable laws and regulations.

Article 7. How are personal data protected?
Hotel Bourgogne & Montana is very vigilant about the security of personal data and takes all reasonable precautions to prevent unauthorized access, disclosure, alteration or destruction of personal data.
Personal data collected is stored by Hotel Bourgogne & Montana or its service providers, and is protected by physical and electronic access controls, firewall technologies and other reasonable security measures.
Such measures cannot, however, prevent all risks of loss, access, misuse or alteration of the personal information collected. Where required by law, Hotel Bourgogne & Montana will notify the User of any loss, access, misuse or alteration of his or her personal data, so that the User may take the appropriate steps to enforce his or her rights. For example, we cannot make anonymous reservations and, if we are not authorized to disclose your personal data to the hotels in our group, we may find ourselves unable to provide certain reservation or other services.
Similarly, if the User does not authorize us to disclose his/her personal data to third parties, such as Hotel Bourgogne & Montana's subcontractors (transfer service, concierge service, ...), we may not be able to provide all possible services or the provision of these services may be delayed. We will do our best to respond to your request as quickly as possible.
